Climate disclosure requirements across the world are rapidly shifting. This past March, the U.S. Securities and Exchange Commission announced that it will no longer defend its 2024 Climate Disclosure Rule in ongoing litigation; the Rule is currently still in effect, but is not being implemented by the agency. At the state level, California’s Climate Corporate Data Accountability Act (SB 253) and Climate-Related Financial Risk Act (SB 261) impose climate disclosure requirements beginning in 2026 for companies who do business in the state and earn more than specified annual revenue thresholds. Similar bills have been introduced in Colorado, Illinois, New York, New Jersey, and Washington, although none have been signed into law. The climate disclosure landscape is also changing internationally, with a recent proposal from the European Union to narrow its Corporate Sustainability Reporting Directive (CSRD) and Corporate Sustainability Due Diligence Directive (CS3D). And Canada recently announced that it will pause the development of its climate-related disclosure rule.
