In 2009, the U.S. Environmental Protection Agency (EPA) published its “Endangerment and Cause or Contribution Findings for Greenhouse Gases Under Section 202(a) of the Clean Air Act,” commonly referred to as the “Endangerment Finding.” Prompted by the U.S. Supreme Court’s landmark decision in Massachusetts v. EPA (2007) and reflecting robust science related to observed and projected health and welfare impacts, the finding determined that six key greenhouse gases qualify as “air pollution” under the Clean Air Act and pose a threat to the health and welfare of future generations.
Ever since, the Endangerment Finding has authorized EPA to set emissions standards for motor vehicles and other major sources of greenhouse gases. However, the Agency recently announced that the Endangerment Finding will undergo reconsideration of whether it “complies with the law and is based on sound science and policy.”
Join the Environmental Law Institute and expert panelists for a discussion on the legal and scientific foundations of the Endangerment Finding. What is the scientific evidence behind the finding, and how does our current, more advanced understanding of climate science substantiate its legitimacy? What legal challenges may arise if the EPA moves forward with a decision to rescind the finding? Our speakers will discuss these questions and more.
